A federal judge has struck down Trump’s immigration detention policy

A federal judge in California on Thursday issued a lower court ruling that upholds the Trump administration’s broad immigration detention powers.

Judge Sunshine Sykes, who was appointed to the bench by Biden, said the government’s claim that it is taking the worst criminals for deportation is “not accurate.”

“‘Worst’ is an inaccurate description of many of those affected by DHS and ICE operations,” Sykes wrote. “Perhaps by using this extreme language DHS wants to justify the size and scope of its operations against non-criminal citizens.”

“Perhaps that name just reflects the harshness and unethical behavior of the Government,” added Sykes. “While these published stories may contain truth, they ignore a larger, more serious truth.”

This decision could prevent mass deportations and ensure bond hearings for many noncriminal detainees.

The Department of Homeland Security (DHS) is allowed to deny bond hearings to those arrested by immigration authorities who have been in the United States for years.

Newcomers are never guaranteed an immediate bond hearing. In June, the Trump administration singled out California and instituted a mass immigration detention policy in the Los Angeles area in an effort to arrest illegal immigrants.

Many of the arrested people have sued, saying they were denied bond hearings. Sykes said the management’s goals were very broad.

“The American people have expressed great concern about the illegal, reckless actions of the executive branch,” Skyes said. “It’s not the ‘worst’ of lawlessness across the country and the indifference of the executive branch. In recent weeks, the Government has arrested Adrian Conejo Arias and his five-year-old son without a warrant.”

“Despite their fear of non-citizens, the executive branch extended violence against its own citizens, killing two American citizens – Renée Good and Alex Pretti – in Minnesota,” the judge said. “The threats posed by the executive branch cannot be viewed in isolation.”

A New Orleans-based appeals court last week ruled in favor of the administration, concluding that DHS’s current detention and bond policy was legal.

The Department of Justice did not immediately comment on the latest decision but is expected to appeal the decision and ask that the detention policies be allowed to continue temporarily while the case is pending.
