According to the complaint, Smith was eager to use the restroom toward the end of the trip and claims the crew encouraged him to go into the water to relieve himself, assuring him the boat’s engine was turned off. The lawsuit alleges that Smith held onto the train for 20 seconds while in the water before trying to get back on board when he felt himself being pulled under the ship.
The letter states that the boat’s captain operated an idling engine while Smith was in the water, causing the propeller to turn and hit his legs. Smith is said to have been able to free himself before calling a friend for help. The situation quickly escalated into a medical emergency as Smith lost more than 60% of his blood, and medical teams rushed him to a hospital in Nassau before transferring him to Miami in critical condition. Despite multiple surgeries and blood transfusions, doctors were ultimately unable to save either leg. According to the complaint, surgeons completely amputated his left leg and amputated his right leg below the knee.
Smith is suing the Sun Cay travel company, Pearl Investment Management Group, and others arrested on the trip, alleging negligence and saying they could have prevented the tragedy. He also named Carnival Cruise in the lawsuit, saying the cruise line promotes the trip as a safe and vetted activity for passengers.
