DOJ settles with PayPal over alleged DEI-based discrimination scheme

The Department of Justice announced a settlement with PayPal, Inc. after the company enforced a “discriminatory investment scheme created for Black and minority-owned businesses.”
“This Department of Justice is fulfilling President Trump’s pledge to eliminate illegal DEI from all American businesses,” Acting Attorney General Todd Blanche said in a statement Tuesday. “Corporate America is on notice: you will face strict enforcement if you use race or ethnicity to discriminate against qualified Americans.”
In 2020, PayPal launched a one-time commitment of $530 million known as the Economic Opportunity Fund “to expand economic opportunity for businesses and communities of underrepresented Black people.” The Department of Justice investigated the program for possible violations of The Equal Credit Opportunity Act, which prohibits creditors from discriminating on the basis of race or color.

While the Justice Department has not ruled that PayPal violated the Equal Credit Opportunity Act or any other federal law, the department says PayPal has not used the program to address past examples of discrimination.
The Justice Department is also not prohibited from taking action against PayPal for any future violations of the Equal Opportunity Act.

As part of this settlement, PayPal will introduce a new Small Business Program and a processing fee waiver for $1 billion in transactions, or approximately $30 million, for veteran-owned or agricultural, manufacturing, or technology-based American businesses.

PayPal was also ordered to inform employees about the Equal Credit Opportunity Act and provide an annual report on the program.
PAYPAL PLANS TO LAUNCH US SMALL BUSINESS BANK
In a statement sent to Fox News Digital, a PayPal spokesperson said, “For more than two decades, PayPal has helped small businesses start, grow and thrive by expanding access to digital financial tools. We are excited to launch the Small Business Initiative to provide America’s small businesses with additional economic opportunities.”
Assistant Attorney General Harmeet K. Dhillon of the Justice Department’s Human Rights Division hailed the decision as an additional effort by the Trump administration to end discrimination among businesses.
