Busfield’s attorney, Larry Stein, insisted that the case against his client was “not substantiated at trial” in a statement sent to Fox News Digital following his indictment.
“The case was unexpected. As the saying goes, the grand jury will put the ham sandwiches,” Stein said.
“The most troubling thing is that the district attorney chooses to proceed with a frivolous and unsubstantiated case in the case. The remand trial exposed fatal weaknesses in the State’s evidence – gaps that cannot be addressed by charging decisions.”

He added, “This prosecution appears to be driven by something other than the facts or the law. Mr. Busfield will fight these charges at every stage and looks forward to testing the State’s case in open court – where the evidence is important – not behind closed doors.”
