A Georgia judge has set a $1 bond for a woman charged with murder after she allegedly took pills to induce an abortion nearly five months into her pregnancy, which is illegal under the state’s abortion laws.
Alexia Moore, 31, has spent nearly three weeks in the coastal Camden County jail after she was arrested on March 4, when police executed an arrest warrant with language similar to the law banning abortions after six weeks of pregnancy.
“I think this case is very problematic,” Supreme Court Justice Steven Blackerby said of the murder charge during Monday’s hearing, according to the New York Times.
“That will be a difficult case to convict,” the judge continued.

Blackerby set Moore’s bond at $2,001, with bond amounts of $1,000 for each of his two drug charges on top of the murder charge.
Moore’s case is the first in Georgia of a woman facing abortion charges since the Peach State’s 2019 abortion ban, which prohibits abortions after fetal heart function is detected, which is usually around six weeks into pregnancy.
District Attorney Keith Higgins of the Brunswick Judicial Circuit did not object to the $1 bond in court Monday and told the judge that police did not contact his office before charging Moore, according to reports.
Higgins’ office will need to find a grand jury before taking Moore to trial.

“Today’s decision is a reminder that justice does not come from allegations alone,” attorneys from the Georgia Public Defender Council, who represent Moore, said in a statement.
“Our system works best when courts examine the facts, respect constitutional protections, and protect the rights of everyone who comes before them,” the statement added.
Moore arrived at the hospital on Dec. 30 and said she was suffering from abdominal pain, according to court records. She told hospital staff that she had taken misoprostol, an abortion drug, and the opioid painkiller oxycodone, according to an arrest warrant obtained by police in Kingsland, Georgia.

The baby survived about an hour after being born at the hospital, according to the search warrant.
A warrant for police to obtain medical records estimated Moore was 22 to 24 weeks pregnant. The document also cited “medical information that the child had a beating heart and was struggling to breathe.”
