Biden wants to block DOJ release of ghostwriter audio in FOIA case

Attorneys for President Joe Biden are expected to challenge the Justice Department’s release of redacted transcripts and audio recordings of Biden’s 2017 interaction with the author of his book, according to a new court filing.

“President Biden, through counsel, has advised the Department that he intends to intervene to prevent any disclosure of this nature,” Civil Division Assistant Attorney General Brett Shumate wrote in a filing resulting from a Freedom of Information Act request by Mike Howell of the Heritage Foundation. “The Department is not opposed to intervention.”

There is a Tuesday deadline for Biden’s lawyers to respond to the DOJ’s release in response to Howell’s FOIA request, which will come as soon as Tuesday if there are no objections.

Shumate noted that the release of the 70-hour re-recording will be delayed until June 15 if Biden objects before the deadline.

“The defendant intends to disclose the written transcripts and recordings addressed in this matter, repeatedly, to Congress, pursuant to a request from the Chairman of the House Judiciary Committee, and to the plaintiffs,” Howell’s FOIA filing with the DOJ read.

The collaboration came between Biden and his ghost for a 2017 book: “Promise Me, Father: A Year of Hope, Difficulty, and Purpose.” The audio and transcripts were obtained by special counsel Robert Hur’s investigation into Biden’s handling of classified documents after the end of the Obama administration, including storing them in his garage and at the Penn Biden Center.

“President Biden has fully cooperated with special counsel Hur, and agreed to release tapes of conversations with his author about his dead son on the condition that they not be disclosed,” Biden spokesman TJ Ducklo told Politico in a statement on Sunday. “The DOJ itself has said that these tapes are not useful to the public.

“What is happening now is not transparent. It is about politics,” Ducklo continued. “If this Presidency were truly committed to transparency, they would release Volume 2 of Special Counsel Jack Smith’s report on Donald Trump’s alleged mishandling of classified documents. That report contains information the American people need to see.”

Fox News reached out to Ducklo for independent confirmation on the report and has not yet responded.

The FOIA requester is still pursuing the documents.

“These tapes will prove a huge lie about Biden’s fitness for office and the fact that Biden disclosed classified information,” Howell, president of Heritage’s Oversight Project, told Politico. “The shenanigans are not over yet: At the last possible moment, and after all possible delaying tactics, the autopen argues that the American people will find out.”

Hur concluded his investigation into Biden’s handling of classified documents, noting the DOJ’s long-standing policy of not indicting a sitting president and saying the judge would sympathize with America’s oldest president, 82, because “he was a well-intentioned, old man with a bad memory.”

“It seems that after long negotiations that lasted several months – he never wanted to intervene in this case early – President Biden has changed his position and now he even wants to order the release of parts of the documents that match exactly the phrases quoted in the Hur report,” Shumate’s letter read on Friday.

“The possible intervention of former President Biden and the new development of his discretion in the House Judiciary Committee in response to their letter of March 23, 2026, raises many issues”:

“As the plaintiffs understand this matter, President Biden will require an order preventing the release of the case and an order directing the Department to bring it all to the House Judiciary Committee by June 15, 2026.”

The DOJ also accused Biden’s lawyers of slow responses and refusing deadlines.

“President Biden’s lead counsel was unable to provide any information regarding President Biden’s submissions that this discussion was somewhat premature (in fact, 16 months late) and it dramatically indicates that without a production date of June 15, 2026, a motion to intervene will not be filed until the middle of the week after the President’s decision. motion to intervene to submit the proposed plan for release,” it read.

The DOJ issued a new warning by Tuesday’s deadline, however.

“The public deserves to hear the tapes and read the documents written by the Justice Department of President Donald J. Trump,” Shumate concluded. “The plaintiffs regret that they are currently unable to assist the Court in this process due to the repeated failure of President Biden’s attorney to communicate with the plaintiffs on this matter, even suspending important discussions until next week.”
